Polygamy: Common Practice in Many Countries
Introduction
Polygamy is basically a practice or custom which gives a man a right to have more than one wives.This is a common practice in many countries. In ayub khan era, an ordinance was passed on 2nd march 1961 and it is known as Family law ordinance 1961. In this ordinance there are 13 sections out of which one is polygamy. There are certain rules for this practice: A man ,if he is already married, can not marry another women unless and until he has taken consent in black and white from arbitration council and secondly any marriage of this kind shall not be enrolled under this dictum. An petition must be given or presented under sub section 1 before the Chairman along with the (prescribed) fee and he must state reasons as to what is the purpose of another marriage.In addition, he must also tell whether he has taken consent of his former wife or wives for this purpose.
The permission of first wife or the wives is very important in this process. The Nikhah registering clerk or the person who ceremonializes nikkah should complete the details of nikkah nama very accurately with answers by asking the bride and bride groom. After the application is being issued,the chairman shall ask the person who has submitted the application and his extant partner to put forward a spokesperson and the Arbitration council if contented that this weeding or matrimony is important as well as necessary shall permit them to do so. Punishment for breaking rulesIf a person breaks the rules of:-Subsection 2, he would be brought to book and imprisoned for a duration which might be upto 30 days and fine of 25,000 rupees. Subsection 3, he would be jailed for a time period of three months.
Secondly he would also have to pay a price(penalty) of 100,000 rupees. If an individual(male) marries one more woman lacking arbitration council's consent, he shall. Recompense the entire quantity of dowry to his existing wife or wives and if does not do so,the amount would be taken from him as arrears of land and revenue.Other than this the person who is found to be guilty shall be imprisoned for a time period of 1 year and a heavy fine of 500,000 rupees has to be paid by him.
Conclusion
Thus we can say that ayub khan made an effort to reduce the rate of polygamy in our country.This was a good step for protection of women rights. If a person wants to get married again, he must have a valid reason for this purpose and permission of his spouse is also important for this procedure.
